Binoljak ng Korte Suprema ang petition na inihain ni Attorney Jesus Nicardo M. Falcis III para s same-sex marriage. Ang desisyon ay ginawa ni Associate Justice Marvic Leonen.
Magugunita na hiniling ni Falcis sa mataas na korte na ideklara na unconstitutional ang isang bahagi ng family code ng Pilpines kung sa nililimitahan lang sa lalaki at babae ang pagpapaksal.
Itinuturing ni Falcis ang kanyang sarili bilang open and self-identified homosexual.
Sa isang press briefing,sinabi ni Court spokesman Brian Keith Hosaka na walang legal standing ang petition ni Falcis kaya ito na-dismissed.
“Adjudication assures arguments between parties with respect to the existence and interpretation of fundamental freedoms. On the other hand, legislation ideally allows democratic deliberation on the various ways to assure those fundamental rights… The process of legislation exposes the experiences of those who have been oppressed, ensuring that this be understood by those who stand with the majority. Often public reason needs to be first shaped through the crucible of campaigns and advocacies within our political forums before it is sharpened for judicial fiat,,” sabi ng korte.
Samantala, si Falcis at ang kanyang counsels ay mahaharap sa indirect contempt.
“(forgetting) bare rudiments of court procedure and decorum or worse, to purport to know them but really only to exploit them by way of propaganda,” paliwanag ng korte.
